Who is the Data Controller?

Who is the Data Processor?
The Data Processor, to whom you can turn to exercise your rights under Art. 12 of GDPR 2016/679 and/or for any clarifications regarding personal data protection, can be contacted by sending an email to: assistenzaonline@leathertrend.it

2. What personal data do we collect?

Leathertrend.it collects and processes the following categories of personal data:

• a) Data for the execution of the purchase contract: first and last name, email address, shipping address, billing address, phone number (landline or mobile), tax code.
• b) Data for the newsletter: email address provided during subscription.
• c) Data provided to Customer Service: all data communicated by the user to receive assistance.
• d) Data for marketing activities (with consent): email address and/or mobile phone number provided by the user to receive promotional communications via email, SMS, or WhatsApp.
• e) Data for registration (Private Area): first and last name, email address, password, date of birth. If you log in via social networks (Facebook, Google), we collect the data necessary for authentication, including the email address.
• f) Navigation data: pages visited, interactions with the Site, and technical logs saved on our servers.
• g) Data of third parties provided by the user (e.g., gift recipient): Leathertrend.it will send the privacy notice to the third party at first communication. The user providing third-party data assumes full responsibility and indemnifies Leather Trend from any claims arising.
• h) Data collected via Trustpilot: identifying data (email, name, purchase experience) and technical data (IP, cookies, navigation), processed for review verification and publication.

Leathertrend.it does not process data of minors. By accessing the Site, you declare that you are of legal age.

3. How do we use the collected personal data?

Leathertrend.it collects and processes your data for the following purposes:

• 1) Execution of the purchase contract: payment management, fraud checks, invoicing, shipping, and returns handling.
• 2) Transactional emails: using your email address to send service communications strictly necessary for contract execution, sent via the Brevo platform (formerly Sendinblue): order confirmation, shipping updates, returns/refunds communications, security notifications. Legal basis: contract execution (art. 6.1.b GDPR).
• 3) Transactional SMS: using the phone number provided during the order exclusively for service communications necessary for contract execution (order confirmation, shipping status, returns, security notifications). Legal basis: contract execution (art. 6.1.b GDPR).
• 4) Post-purchase commercial emails (soft spam): after purchase, we may send you emails about products and services related to your purchase, pursuant to art. 130, co. 4 of Legislative Decree 196/2003. You can unsubscribe at any time via the unsubscribe link or by contacting Customer Service.
• 5) Email marketing (with your explicit consent): with your consent, we will send promotional communications via email (new products, offers, event invitations). You can withdraw consent at any time.
• 6) WhatsApp messages via WhatsApp Business API (with your explicit consent): with your separate consent, we use your phone number to send transactional and/or commercial messages via WhatsApp Business API, managed through Brevo (Meta-certified Business Solution Provider). Brevo acts as Data Processor for technical management. Meta Platforms Ireland Ltd. acts as an independent controller for its platform infrastructure and security, while the processing for messages requested by you is under Leather Trend’s responsibility. You can revoke consent by replying STOP to the message or via the Private Area preferences.
• 7) Marketing via other channels (with consent): phone, postal mail.
• 8) Personalization of experience (with consent): analysis of purchases and browsing preferences to offer personalized promotions.
• 9) Statistical analysis: use of aggregated information to improve services.

4. Cookie Policy

The Site uses tracking tools. For more information, see our Cookie Policy. The Site uses the Trustpilot review service, which may place cookies on your device with your consent via the cookie management banner. Data collected is processed by Trustpilot as an independent controller pursuant to its own Privacy Policy (https://it.legal.trustpilot.com/for-reviewers/end-user-privacy-terms). You can manage your preferences at any time through the Site’s cookie banner.

5. Your PRIVATE AREA account

By creating your account (Private Area), you have access to: My Orders, Wishlist, My Data, My Addresses, Communication Preferences (self-managed consent for email marketing and WhatsApp).

6. Legal basis for processing

• Contract execution (art. 6.1.b GDPR): purchase, registration, customer service, transactional email/SMS. Provision is mandatory to complete the purchase.
• Legal obligation (art. 6.1.c GDPR): tax, accounting, and regulatory compliance.
• Legitimate interest (art. 6.1.f GDPR): anti-fraud activities, soft spam (art. 130 co. 4 D.Lgs. 196/2003), internal administrative purposes.
• Explicit consent (art. 6.1.a GDPR): email marketing, WhatsApp, marketing on other channels, personalization, Trustpilot cookies. Revocable at any time.

7. Who will process your data?

Your data will be processed by trained internal staff of Leathertrend.it. For digital communication management (transactional emails, email marketing, SMS, WhatsApp), we use Brevo SAS (7 rue de Madrid, 75008 Paris, France), appointed as Data Processor pursuant to art. 28 GDPR. Other processors include banks and payment systems, couriers, IT providers, and CRM companies. Data may also be disclosed to Trustpilot A/S and Meta Platforms Ireland Ltd., which act as independent controllers for their services, and to law enforcement and authorities when required by law.

8. Data transfer abroad

Data is stored on servers within the European Union. Brevo SAS is based in France (EU). Any extra-EU transfers by Brevo, Meta, or Trustpilot comply with the guarantees provided by arts. 46, 47, or 49 GDPR (standard contractual clauses, adequacy decisions).

9. How long do we keep your data?

• Data for contract execution: until completion of administrative/accounting formalities; invoices for 10 years.
• Registered user data: until account deletion.
• Data for soft spam: until unsubscribed.
• Data for email marketing, WhatsApp, and personalization: until consent withdrawal and in any case within 2 years from the last interaction.
• Data for Trustpilot reviews: until review removal or deletion request.

Permanent deletion occurs within 30 days from the above deadlines.

10. Your rights

You can exercise your rights of access, rectification, deletion, restriction, objection, portability, and consent withdrawal by contacting the Data Controller at the contacts indicated in point 1, accessing your Private Area, or writing to assistenzaonline@leathertrend.it (subject: “Privacy”). We may ask you to verify your identity before processing the request.

11. Security measures

We implement appropriate technical and organizational measures to ensure the confidentiality, integrity, and availability of data. Brevo SAS adopts GDPR-compliant certified measures.

12. Complaints

If you believe that the processing of your data is unlawful, you can lodge a complaint with the Italian Data Protection Authority (www.garanteprivacy.it).

13. Changes to this notice

Any changes will be published on this page with the update date indicated. We invite you to check the contents periodically. The date of the last update is also indicated at the bottom of this document.

The processing is carried out in compliance with Regulation (EU) 2016/679 (GDPR), Legislative Decree 196/2003 as amended by Legislative Decree 101/2018, and the provisions of the Data Protection Authority.
